General Payment Terms

• For standard bookings, payment is due upon completion of the job and receipt of the invoice. Some products are pay-to-download.
• Accepted payment methods include major credit cards, PayPal, digital wallets, ACH transfer, check, and cash.
• A late payment fee of 5% of the total amount due will be assessed if payment is not received within 7 calendar days of the invoice date. Thereafter, an additional 1.5% interest will be applied for each additional 7-day period the balance remains unpaid.
• Payments mailed and postmarked before the 7-day deadline will not incur a late fee.
• Please make checks payable to Drone Elevations, LLC.
• Bookings generally require a minimum of 12 hours’ notice. Same-day requests may be accommodated based on availability—please call (863) 333-4265.
• Some projects may require an initial deposit before work commences.

Licensing Terms & Conditions

Licensing Terms & Conditions Summary: Marketing use of media deliverables is permitted with some limitations. Resale or transfer is not permitted. Copyright and the right to resell is retained by Drone Elevations. No signatures are required.

These Licensing Terms & Conditions (“Terms”) are provided by Drone Elevations, LLC (“Drone Elevations,” “we,” “us,” or “our”) and apply to any client, customer, or recipient (“Recipient,” “you,” or “your”) who purchases, receives, downloads, accesses, or uses any photo(s), video(s), and/or other visual content created or delivered by Drone Elevations.

By accessing, downloading, receiving, using, publishing, or distributing any content delivered by Drone Elevations (the “Work,” defined below), you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not access or use the Work or our website.

1. Definitions

Subject Property means the real property, space, location, or project that is the subject of the visual content produced by Drone Elevations for Recipient, which may include a listing, marketing project, or other real estate-related assignment.

Work means photo(s), video(s), and/or 3D content, floor plans, graphics, audio, animation, constituent files, and other visual content of the Subject Property produced by Drone Elevations, including any derivative works created therefrom.

2. Grant of Usage Rights to Recipient (“Your License”)

Drone Elevations grants Recipient a print and marketing release and the right to use the Work provided by Drone Elevations solely for the purposes of:

• marketing and promoting the Subject Property;
• promoting your real estate business and/or the listing(s);
• promoting your brokerage(s) and/or your business(es) (collectively, “Your License”).

Your License is:

• non-exclusive and non-transferable;
• valid for all territories and media;
• for an unlimited time on websites owned by you; and
• valid while the listing is active under your name, if applicable.

​You may authorize third-party websites such as, but not limited to, Multiple Listing Service (MLS) or real estate listing portal websites to display the Work solely for the purpose of advertising the applicable listing, for as long as said listing is actively listed for sale by that listing agent.

3. Grant of Rights to Drone Elevations

Recipient grants to Drone Elevations, and its affiliates, contractors, commercial partners, licensees, successors and assigns a non-exclusive, perpetual, fully transferable, sublicensable worldwide right and license to create, reproduce, display, transmit, and distribute the Work through any and all media now known or hereinafter developed.

Drone Elevations reserves the right to use the Work for the company’s portfolio, samples, self-promotions, entry in contests or exhibitions, editorial use, or for display within or on the outside of Drone Elevations’ premises. Drone Elevations further reserves the right to assign, transfer, license, distribute, or syndicate the Work and any and all rights in the Work to its commercial partners.

Any and all rights not expressly granted here are reserved to Drone Elevations, including copyright and ownership rights in the Work.

4. Copyright, Ownership, and Restrictions

All copyrights and ownership rights in the Work remain with Drone Elevations.

This release does not include rights of sale, does not constitute a release of copyright, and Recipient has no right to sell or license the Work to any third party.

Recipient may not copy, modify, reproduce, or create derivatives of the Work without the prior written consent of Drone Elevations.

Permission is not granted for photo contest entry without the express written permission of Drone Elevations.

Drone Elevations retains the right to resell photos and/or videos as stock photography/video.

5. Exclusive Rights / Copyright Transfer Requests

To request a transfer of copyright for exclusive rights, Recipient must contact Drone Elevations for written permission. No exclusive rights are granted unless expressly agreed to in writing by Drone Elevations.

6. Duplicate Version with Copyright Line

A duplicate version of the Work with the copyright line may be included for Recipient’s marketing purposes. Recipient is encouraged to use these materials (with copyright) for marketing materials, social media, and other applicable platforms to ensure the protection of both parties from copyright infringement.

7. Proof of License

A copy of these Terms shall be considered adequate proof of release and/or license by a printer or other third party.

8. Indemnification / Hold Harmless

Recipient shall indemnify and hold Drone Elevations, LLC, its officers, members, employees, contractors, licensees, sublicensees, agents, successors and assigns harmless from and against any and all liability, claims, injuries, damages, loss, expense, (including court costs and reasonable attorneys’ fees) resulting from the performance of these Terms, or any distribution or use of the Work resulting from Recipient’s breach of any warranties, representations or certifications hereunder, or resulting from Recipient’s negligent or intentional acts or omissions and/or those of Recipient’s officers, agents, independent contractors, employees, family members, invitees, licensors, the Subject Property owner, and/or guests.

9. Website Terms of Use / Disclaimer

You agree that your use of the Drone Elevations website is subject to these Terms. These Terms may be modified at any time and from time to time; the date of the most recent changes or revisions will appear on this page. Continued access to the website by you will constitute your acceptance of any changes or revisions. If you do not agree with the Terms, please do not use this website.

The materials contained on the website are provided by Drone Elevations, LLC as a service to you for your noncommercial, personal use on an "as is, as available" basis and may be used by you for information purposes only. You acknowledge that you are using the website at your own risk.
